EVOKE Photography & Video, Inc. (“Company” or “we”) is committed to protecting the privacy of our online guests at www.evokephotoandvideo.com  (“Site”) on the EVOKE mobile application (“App”), and related systems and software, all collectively referred to as the “Platform.” This privacy policy (“Privacy Policy”) is intended to provide you notice of our information management practices, including the types of information gathered and how it is used and safeguarded on the Platform.  Your use of the Platform constitutes acceptance of this Privacy Policy. 

Collection And Our Use Of Information

We will collect no personally identifiable information about you when you visit or use the Platform unless you voluntarily choose to provide that information to us.  Any personally identifiable information that you provide to us via the Platform will be used only for such purposes as are described either in this Privacy Policy or at the point of collection, such as to respond to your questions or comments, or to make payments towards a Wedding Service Contract.  The type of personally identifiable information we may collect from you when you choose to provide it may include, amongst other things, your: name, e-mail address, phone numbers, credit card number, age, contact information, gender, and related information if using the Platform to facilitate the creation of a Wedding Service Contact.  If you provide contact information, we or our agents may contact you to clarify your comment or question, or to learn about your needs or level of customer satisfaction with our services.  We may use the information you give us to help us provide better products and services and to send you information or materials related to services we provide. In order to provide our services, we will also collect relevant Event-related information, service preferences (for photo and video services), planned wedding dates and other details.  

Sharing Of Information

The Company may disclose personally identifiable information about you to a subsequent owner or operator of our Site if we assign our rights and obligations regarding any of your information at the time of a merger, acquisition, or sale of all or substantially all of our assets or the Platform's assets and/or services to a subsequent owner or operator.  You will be deemed to have consented to the disclosure to, and use by, a subsequent owner or operator of the Platform, and your continued use of the Platform signifies your agreement to be bound by the Privacy Policy of the Platform's subsequent owner or operator.  

The Company may also disclose personally identifiable information to third parties in the following instances: 1) we have been given your consent to disclose or disclosure is necessary to perform services rendered (e.g. matching you with a Shooter or the appropriate services); 2) we have previously informed you of the disclosure, including by means of our Privacy Policy; 3) we are required by law or court order to disclose, or we believe in good faith that the law requires it; 4) disclosure is necessary to identify, contact, or bring legal action against, someone who may cause or be causing harm to, or interference with, our rights or property, other Platform users, or anyone else; or 5) to respond to an inquiry, request or complaint that you have made.  We may also use IP addresses in cooperation with internet service providers to identify users if we deem it necessary to comply with laws, to enforce compliance with this Privacy Policy, or to protect our Platform, customers, or others.

Additionally, the Company may collect, use or disclose personally identifiable information, either directly or on behalf of another Platform user, for the purposes of offering our wedding photography and video matchmaking services on your behalf - this enables us to provide you with recommended wedding services providers (e.g., photographers or videographers) process payments, and provide similar services.  Depending on the level of services provided, we may rely on local service providers (in the U.S. or other countries) and may be required to provide such service providers your personally identifiable information.  When you use the Platform to facilitate the creation of a Wedding Service Contract, you consent to collection, use and disclosure of your personally identifiable information by the Company – and the corresponding collection and use by the relevant service providers – for the purposes of administering and delivering the services you requested.

Statistical Vs Personal Information

Some non-personally identifiable information is collected and stored automatically when you use the Platform.  If you do nothing during your visit but browse through the Site, read pages or download information, we will gather and store certain information about your visit automatically.  This information does not identify you personally.  Our system collects data in the server log that may include, amongst other things:

  • IP address

  • Domain name

  • Type of browser

  • Operating system

  • Pages viewed

  • Search requests

If you linked to our Site from another web site, that web site's address may be logged.  We may aggregate this data and use it for statistical purposes.  For example, the aggregated data helps us to determine the volume of our Site users' interest in areas of our Site.  It also helps us understand how we can improve the navigation and content of our Site.  We may disclose this information to third parties.

Use Of Cookies

Non-personal information may also be collected with the use of cookies.  “Cookies” are small text files a web site can use to recognize repeat users.  When someone visits the Site, a cookie is placed on the customer's machine (only if the visitor's web browser has been set to accept cookies) or is read if the visitor has visited the Site previously.  The Company may collect aggregated Site-visitation statistics using cookies.

Security

We will make reasonable efforts to ensure that whatever information you provide will be maintained in a secure environment.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure.  While we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us or from the Platform, and you provide such information at your own risk.  The Platform may contain links to other sites, including those of our authorized business partners.  While we seek to link only to sites that share our high standards and respect for privacy, we are not responsible for the privacy practices employed by other sites.

Notice To Users Outside Of U.S.

The Platform is operated in the United States. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By providing us with any information through the Platform, you consent to this transfer.

Changes To Policy

The Company may, at any time, revise these policies by updating this posting.  Your continued use of this Platform indicates your acceptance of all revisions, and you should, therefore, periodically visit this page to review these policies for changes.

Dispute Resolution

Any dispute concerning the Platform, or Services offered or provided by EVOKE will be resolved per the dispute resolution provision in our Terms of Use Agreement.  The Terms of Use Agreement govern your use of the Platform.
